2008-0366/2/2008 • ORDINANCE NO. 2008- 36 AN ORDINANCE APPROVING A PRELIMINARY PLAN VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Affinity Health Care, LLC (1450 Busch Parkway, LLC) 1450 Busch Parkway Corporate Grove Subdivision 1 .v WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property described in Exhibit A hereto (hereinafter referred to as the "Property") is zoned in the Industrial District pursuant to the Corporate Grove Annexation Agreement dated May 7, 1984; and, WHEREAS, ECD — 1500 LLC is the owner of the Property; and, WHEREAS, 1450 Busch Parkway, LLC is the contract purchaser of the Property, (hereinafter referred to as "Developer ") and Affinity Health Care, LLC is the prospective tenant of the medical office building proposed for construction on the Property; and, WHEREAS, Developer is requesting approval of a Preliminary Plan pursuant to the Village Development Ordinance to construct a medical office building of approximately 64,891 square feet and related site improvements as depicted on the following exhibits: EXHIBIT A Legal Description EXHIBIT B Preliminary Plan ( "Schematic Site Plan," Sheet A -1) dated May 23, 2008 by McShane Construction EXHIBIT C Preliminary Engineering Plan (Sheet 1— Grading Plan and Sheet 2 — Utility Plan) dated May 28, 2008 by Manhard Consulting EXHIBIT D Preliminary Landscape Plan (Sheet L -2) dated May 28, 2008 by Ives/Ryan Group, Inc. ® 2. • EXHIBIT E Preliminary Photometric Site Plan for Outdoor Lighting (Sheet E- 1, 11x17 inches) dated April 10, 2008 by Kornacki & Associates EXHIBIT F Proposed outdoor lighting standard and fixture (8 '/z x I l inches) dated April 10, 2008 by Kornacki & Associates EXHIBIT G Proposed trash enclosure (8 '/2 by 1 l inches) dated May 2, 2008 by McShane Construction EXHIBIT H Proposed monument (ground) sign (8 '/2 x 11 inches) dated April 4, 2008 by McShane Construction EXHIBIT I List of Proposed Building Materials dated April 28, 2008 by McShane Construction EXHIBIT J Building elevations (Sheet A -1, 11x17 inches) dated May 5, 2008 by Marasco & Associates, Inc. EXHIBIT K Renderings of proposed building (color sheets, 8 '/2 x 11 inches) WHEREAS, the Village Plan Commission conducted a public hearing on May 21, 2008, and based on the exhibits and testimony provided at the hearing, voted unanimously to recommend approval of the Preliminary Plan including variations of the Village Zoning Ordinance and Development Ordinance; and, WHEREAS, the President and Board of Trustees have determined that the proposed Preliminary Plan and related variations of the Village Zoning Ordinance and Development Ordinance are appropriate for the Property, and that the Developer has cooperated with the Village in unified planning for the Property and adjacent properties in terms of Village utilities and vehicular access for public use of the shared driveway serving the properties; and, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby incorporated herein. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving the Preliminary Plan for the Property pursuant to Exhibits B through K attached hereto and subject to the following conditions: ® 3 e A. The following variation of the Village Zoning Ordinance is hereby granted, pursuant to Exhibits B and C hereto: Section 17.36.040.G.7. — to allow elimination of required parking spaces to provide pedestrian paths and additional landscaping in the parking areas. B. The following variations to the Village Development Ordinance are hereby granted, pursuant to Exhibit C hereto: i.) Section 16.50.040.C.4 — to allow side slopes greater than 5:1 for a retaining wall to be constructed adjacent to the pond on the Property to provide the required stormwater detention and floodplain capacity; ii.) Section 16.50.050.D.7. — to allow the reduction in the minimum depth of the sanitary sewer line from the required 6 feet to 4.5 feet. C. Prior to the commencement of any development activities on the property, Developer shall submit sufficient data to the Village and FEMA to obtain a Conditional Letter of Map Revision (CLOMR). Upon completion of the floodplain modification, Developer shall submit a completed Letter of Map Revision (LOMR) application to FEMA which shall be received prior to the issuance of any Certificate of Occupancy. D. Developer shall obtain written approval from the Corporate Grove property owners' association concerning modification of the stormwater management system on the Property and any other approval within the authority of said property owners' association prior to issuance of a building permit by the Village for any construction on the Property. E. It is understood and agreed that any signs on the Property, including the ground signs depicted on Exhibits B and H are not approved by this Ordinance and are subject to the requirements and standards of the Village Sign Code. F. Developer shall submit a final plat of subdivision and Development Improvement Agreement in compliance with the applicable requirements of the Village Development Ordinance, prior to application for a building permit. G. Fire lanes shall be depicted on said plat of subdivision in accordance with the recommendations of the Village Deputy Fire Marshal. H. Developer shall dedicate public utility easements, including easements for Village water and sanitary sewer lines adjacent to the shared drive on the east side of the Property as approved by the Village, and said easements shall be 0 4 0 delineated on the plat of subdivision as depicted on Exhibits B and C hereto. I. Developer shall construct the 12 —inch water main and 12 —inch sanitary sewer line adjacent to the shared access drive on the east side of the Property as depicted on Exhibit C hereto. J. Developer shall dedicate a public access easement and construct the shared access drive on the east side of the Property as depicted on Exhibits B and C hereto. Said public access easement shall be delineated on the plat of subdivision. K. Developer shall submit a final landscaping plan for review and approval by the Village Forester and the Village Forester shall make the determination concerning compensation for trees that are removed from the Property, pursuant to applicable requirements of the Village Development Ordinance. Section 3. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified.
