2008-023ORDINANCE NO. 2008- 23 AN ORDINANCE AMENDING CHAPTER 2.08, VILLAGE MANAGER, OF THE BUFFALO GROVE MUNICIPAL CODE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the Village purchases fuel for its vehicles on a recurring basis and because of the volatility of fuel prices formal solicitation of bids would not be timely; and WHEREAS, in order to purchase fuels on the spot market the Village Manager needs to be able to make immediate decisions without the formal solicitation of bids. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT and BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, LAKE and COOK COUNTIES, ILLINOIS, as follows: Section 1. The foregoing recitals are hereby adopted and incorporated into and made a part of this Ordinance as if fully set forth herein. Section 2. Subsection I. of Section 2.08.040 of the Buffalo Grove Municipal Code is hereby amended to read as follows: 2.08.040 Duties I. Purchase all materials, supplies, equipment, personal services and contracts for which funds are provided in the budget, but no item or personal service which exceeds any budget appropriation may be purchased. For a purchase of more than fifteen thousand dollars, the Village Manager shall be required to solicit bids and such bids shall be presented to the Corporate Authorities for approval or rejection. The Village Manager may purchase fuel on a recurring basis without the formal solicitation of bids. For any public improvement which will exceed fifteen thousand dollars, which is not to be paid for in whole or in part by a special assessment or special tax, the Village Manager shall be required to solicit bids and such bids shall be presented to the Corporate Authorities for approval or rejection. The Village Manager shall make recommendations to the Corporate Authorities with respect to all such bids. The Village Manager may issue rules and regulations governing requisitions and the transaction of the business of the purchasing agent and the heads of departments, officers and employees of the Village. In case of circumstances creating an emergency, the Village Manager may, without prior 1 0 0 consent of the Corporate Authorities, award contracts and make purchases for the purpose of meeting the emergency; but shall promptly file with the Corporate Authorities a report of such emergency and the necessity of such action, together with an itemized account of all such expenditures. If authorized by a vote of two- thirds of all the Trustees then holding office, the bid requirements in this section may be waived. Section 3. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this ordinance. Section 4.
