2008-014ORDINANCE NO. 2008- 14 GRANTING A VARIATION FROM SECTION 14.20.010 OF THE BUFFALO GROVE MUNICIPAL CODE (SIGN CODE) Lord's Love Communit y Church, 1250 Radcliffe Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Lord's Love Community Church, an Illinois religious corporation, the owner of the hereinafter legally described real property commonly known as 1250 Radcliffe Road, Buffalo Grove, Illinois, has requested a variation from Section 14.20.010, pertaining to Residential Districts, of the Village's Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of installing an additional identification wall sign on the west elevation of the building which sign would exceed the allowable square footage for all signs on the property by eighteen (18) square feet; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on the said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Sign Code, and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variation will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variation will not be contrary to the general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. 0 0 NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Section 14.20.010 of the Buffalo Grove Municipal Code to the property legally described as follows: That part of the west '/x of Section 8, Township 42 north, Range 11, east of the Third Principal Meridian, bounded by a line described as follows: Commencing at a point on the south line of the northwest '/a of said Section 8 66.50 feet east of the west line of the east 'h of the northwest '/a of said Section 8; thence north 00 degrees 03 minutes 37 seconds east along a line parallel to said west line, 637.42 feet; thence south 89 degrees 56 minutes 23 seconds east, 298.50 feet; thence south 10 degrees 31 minutes 31 seconds east, 1205.74 feet; thence north 89 degrees 32 minutes 59 seconds west, 143.51 feet; thence north 00 degrees 27 minutes 01 seconds east, 95.00 feet; thence north 68 degrees 12 minutes 36 seconds west, 137.39 feet; thence north 89 degrees 32 minutes 59 seconds west, 250.00 feet to a point 66.50 feet east of the west line of the east % of the southwestl /4 of said Section 8; thence north 00 degrees 07 minutes 47 seconds east along a line parallel to said west line 398.80 feet to the place of beginning, in Cook County, Illinois, which lies north of a line, parallel to the south line of the northwest quarter of Section 8, Township 42 north, Range 11, east of the Third Principal Meridian, which line intersects the west line of the above described property 475.00 feet south of the northwest corner thereof, in Cook County, Illinois. for the purpose of installing an additional identification wall sign on the west elevation of the building which would exceed the allowable square footage for all signs on the property by eighteen (18) square feet. Section 3. The variation shall be subject to the following conditions: A. The sign is to be installed in accordance with the Zoning Board of Appeals Exhibit "E ", and Section 4. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified. The pamphlet form of Ordinance No. 2008 -14, including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing on March 18, 2008 and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of Village Clerk.
