2007-08011/12/2007 ORDINANCE NO. 2007- 80 An Ordinance Amending Chapter 2.28, Board of Fire and Police Commissioners, of the Buffalo Grove Municipal Code. WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; WHEREAS, the Corporate Authorities of the Village recognize the need to expand the pool of eligible candidates for appointment as a police officer; and WHEREAS, the Buffalo Grove Board of Fire and Police Commissioners ( "Board ") has recommended as an additional method to original entry appointment of police officers the consideration of lateral entry appointment of Illinois Certified Police Officers to the Village's Police Department pursuant to the Board's Rules and Regulations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT and BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, LAKE and COOK COUNTIES, ILLINOIS, AND PURSUANT TO ITS HOME RULE AUTHORITY, as follows: Section 1. The foregoing recitals are hereby adopted and incorporated into and made a part of this Ordinance as if fully set forth herein. Section Z. Section 2.28.010 of the Buffalo Grove Municipal Code is hereby amended to read as follows: 2.28.010 Adoption of State Code. Division 2.1 of Act 5 of Article 10, Chapter 65 of the Illinois Compiled Statutes, entitled Board of Fire and Police Commissioners, is adopted by reference, provided that Sections 10- 2.1 -1, 10- 2.1 -2, 10- 2.1 -3, 10- 2.1 -4, 10- 2.1-5, 10- 2.1 -5, 10- 2.1 -6(a), 10- 2.1 -14, 10- 2.1 -15, 10- 2.1 -16, 10- 2.1 -17, 10- 2.1 -20, 10- 2.1 -27, and Division 3 of Article 10, and Division 5 of Article 10, both of the Illinois Compiled Statutes are not adopted. Section 3. Subsection A. of Section 2.28.040 of the Buffalo Grove Municipal Code is hereby amended to read as follows: 2.28.040 Appointment of Members- -Fire and Police Departments. A. The Board of Fire and Police Commissioners shall appoint all officers and members of the Fire and Police Departments of the municipality, except those positions exempted by Village ordinance. The sole authority to issue certificates of appointment shall be vested in the Board of Fire and Police Commissioners, and all certificates of appointment issued to any officer or member of the Fire or Police Department shall be signed by the • 0 chairman and secretary, respectively, of the Board of Fire and Police Commissioners upon appointment of such officer or member of the Fire or Police Department by action of the Board of Fire and Police Commissioners. Section 4. Section 2.28.043 of the Buffalo Grove Municipal Code is hereby repealed. Section 5. Section 2.28.044 of the Buffalo Grove Municipal Code is hereby amended to read as follows: 2.28.044 Register of Eligibles. The Board of Fire and Police Commissioners shall prepare and keep a register of persons whose general average standing, upon examination, is not less than the minimum fixed by the rules of the Board, and who are otherwise eligible. The candidates shall take rank upon the register as candidates in order of their relative excellence as determined by examination, without reference to priority of time of examination. Within sixty days after each examination, an eligibility list shall be posted by the Board, which shall show the final grades of the candidates without reference to priority of time of examination and subject to claim for military credit. Candidates who are eligible for military credit shall make a claim in writing within ten days after the posting of the eligibility register or such claim shall be deeded waived. Appointment shall be subject to a final physical examination. If a person is placed on an eligibility list and becomes overage before he or she is appointed to the police or fire department, the person remains eligible for appointment until the list is abolished pursuant to authorized procedures. Names of candidates for original appointment will be removed from the entry eligibility list after having been on the list for more than two years. Section 6. Section 2.28.045 is added to the Buffalo Grove Municipal Code as follows: 2.28.045 Police Officer Lateral En A. In lieu of the procedures set forth in Sections 2.28.044 and 2.28.060 the Board of Fire and Police Commissioners may provide for a police officer lateral entry program, which program shall comply with the other requirements of this Chapter and the Rules and Regulations of the Board. B. The Board shall prepare a police officer lateral entry eligibility list which will be active for twelve (12) months before being recreated. C. A candidate for police officer will be drawn from the lateral entry eligibility list when (i) the traditional entry eligibility list has been 2 • exhausted or (ii) when the Board determines it is necessary in the interests of public safety. Section 7. Subsection C. of Section 2.28.050 of the Buffalo Grove Municipal Code is hereby amended to read as follows. 2.28.050 Rules and Publications. C. These rules of the Board shall apply to the conduct of examinations for original appointments, for lateral entry of police officers, for promotions, to the standards for part-time police officers and to the conduct of hearings on charges brought against a member of the Police or Fire Department. No such rules shall be made by the Board to govern the operation of the Fire or Police Department, or the conduct of its members. Section 8. if any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this ordinance. Section 9.
