AN ORDINANCE APPROVING REZONING TO THE
R -3 ONE - FAMILY DWELLING DISTRICT,
VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS
Field property
2801 Prairie Road and 16468 W. Brockman Avenue
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, Scott Field and Brenda Field are the owners (hereinafter referred to as
"Owner ") of the real property legally described in EXHIBIT A ( "Property ") attached hereto; and
WHEREAS, the Property as described in attached EXHIBIT A is zoned in the
Residential Estate (R -E) District pursuant to the Annexation Agreement dated June 5, 2006 and
Village Ordinance No. 2006 -33; and,
WHEREAS, said Annexation Agreement grants a variation of the Village Zoning
Ordinance to allow the front yard along Prairie Road for the existing house at 2801 Prairie Road
as depicted on Exhibit B (plat of survey) attached hereto,
WHEREAS, said Annexation Agreement contemplates that the existing house at 2801
Prairie Road would be improved with building additions, and the vacant parcel at 16468 W.
Brockman Avenue would be developed with a single - family detached house; and,
WHEREAS, Owner has presented plans for building additions to the existing house at
2801 Prairie Road, and said plans would require substantial variations of the building setback
standards of the Residential Estate District; and,
WHEREAS, rezoning the Property to the R -3 One - family Dwelling District would allow
the proposed building additions at 2801 Prairie Road to be constructed without variations of the
applicable zoning standards; and,

WHEREAS, the R -3 district standards are compatible with the zoning and platting of
adjacent properties in the Village and unincorporated parcels; and,
WHEREAS, Owner has petitioned to the Village for rezoning of the Property to the R -3
District pursuant to the following exhibits:

WHEREAS, notice of public hearing concerning the rezoning was given and the hearing
was held by the Buffalo Grove Plan Commission on March 7, 2007; and,
WHEREAS, the Plan Commission determined, based on the testimony at the public
hearing, that rezoning of the Property is appropriate and would be compatible with adjacent
properties; and,
WHEREAS, the President and Board of Trustees after due and careful consideration have
concluded that the use of the Property on the terms and conditions herein set forth would enable
the Village to control development of the area and would serve the best interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLIOIS:
Section 1. This Ordinance is made pursuant to and in accordance with the Village's
Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding
whereas clauses are hereby made a part of this Ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and binding
ordinance approving rezoning to the R -3 District for the Property.
Section 3. This Ordinance shall be in full force and effect on and after its passage and
approval. This Ordinance shall not be codified.

Moved by Commissioner Teplinsky, seconded by Commissioner Smith to recommend approval
to the Village Board of a petition for rezoning from the Residential Estate (RE District) to the R-
3 District (One - family Dwelling District) for an existing single family residence at 2801 Prairie
Road and a vacant parcel at 16468 W. Brockman Avenue.
Chairman Ottenheimer called for a vote on the motion and the vote was as follows:

Chairman Ottenheimer called the hearing to order at 7:30 p.m. in the Village Council
Chambers, Buffalo Grove Municipal Building, 50 Raupp Boulevard, Buffalo Grove,
Illinois. Chairman Ottenheimer read the Notice of Public Hearing as published in the
Buffalo Grove Daily Herald, explained the procedure to be followed for the public hearing,
and swore in all persons who wished to give testimony.

Mr. Flubacker stated he is working with the petitioner on a residential remodeling at an existing
home at 2801 Prairie. The property was annexed into the Village of Buffalo Grove several years
ago in at RE zoning. At that time in the annexation agreement there was some language
referring to the fact that the project would be remodeled in the future and that some sort of
zoning accommodation would be necessary at that time.
Mr. Flubacker reviewed the lot noting that it is the only piece of property in the area that is
within the Village of Buffalo Grove. The contiguous Buffalo Grove properly is across Prairie on
the west side and is currently zoned R -4.
Mr. Flubacker reviewed the property analysis given two different zoning classifications. The
two parcels with an RE zoning. Each lot would have its own front, rear and side setbacks. The
rear setback is in front of the front setback so there is zero buildable area on that piece of
property using the current zoning setbacks. The most appropriate zoning they looked at as far as
lot size and other requirements was R -3 zoning.
Mr. Flubacker noted their proposal for remodeling including a small addition of a covered front
porch which does not require a variation. The significant addition is in the back which would
fall within all of the zoning setbacks making any action by the zoning board in this case moot.
Commissioner Teplinsky asked why this parcel was given the RE designation.
Mr. Pfeil stated the RE zoning is a holding district for most development in the Village. It
seemed prudent because we were doing our planning for that area to be as conservative as
possible on the annexation but the property did certainly indicate that a building addition was
contemplated. One way or the other zoning relief would have been needed when we annexed it
with RE to really make any additions to the property or to build a new house on the vacant parcel
that would have needed either rezoning or some kind of substantial setback relief.
There being no further comments or questions from anyone else present, Chairman Ottenheimer
closed the public hearing at 7:45 p.m.
