ORDINANCE 2005- 48
An Ordinance Adding Chapter 15.28 of the
Village of Buffalo Grove Municipal Code pertaining to
Bi- directional Amplification Systems
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the provisions of
the Constitution of the State of Illinois of 1970; and
WHEREAS, reliable radio communications are critical for public safety operations and a bi-
directional amplification system properly installed within a building will aid to ensure maximal radio
communication efficiency by and between public safety departments; and
WHEREAS, lack of portable radio communications within a building presents dangerous
situations and conditions, which are liable to cause or contribute to a variety of emergency
situations within a building, including but not limited to, fire spread, hostage situations, natural
disasters, collapse, firefighter or police officer injuries or death, occupant injuries or death
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS,
as follows:
Section 1. The foregoing are incorporated herein as if fully set forth hereby.
Section 2. Chapter 15.28 is hereby added to the Village of Buffalo Grove Municipal Code, to read
as follows:
Chapter 15.28
131-Directional Amplification Systems
15.28.010 Definitions
For the purposes of this Chapter, the following terms are hereby defined as follows:
A. "Bi- directional amplification system" (BDA) is a system that improves radio communications
within a building through an antenna system and amplifier built into the building. This
system provides radio communications from portable radios operating in the building to
components outside of the building creating a complete radio communication transmission.
B. "Partition" refers to exterior walls of a building and interior walls of a building. As an
example, two partitions would include one exterior wall and an interior office wall.
C. "Public safety radio communication system" refers to the current digital 800 MHz radio
system, or any future radio system used by the Village of Buffalo Grove Fire and Police
Departments.
D. "90% Standard" refers to successful, clean communication between two radios through two
partition walls 90% of the time.
15.28.020 BDA Systems

A bi- directional amplification system shall be installed in a building when the 90% standard is not
met.
15.28.030 Applicability
The provisions of this Chapter shall apply to all new buildings and existing buildings when additions
or alterations within any twelve -month period exceed twenty -five percent of the area of the existing
building.
Exception:
A. One family residential and buildings less than three stories.
15.28.040 Responsibility for Compliance
The owner of any building or designated agent shall be responsible for compliance with the
requirements of this Chapter.
15.28.050 Testing
Whenever there is insufficient evidence of compliance with the provisions of this Chapter or
evidence that any material or any construction does not conform to the requirements of this
Chapter, or in order to substantiate claims for alternate materials or methods of construction, the
Village may require tests as proof of compliance to be made at the expense of the owner.
When any required radio communication enhancement system is installed and becomes
inoperative thus affecting the safety of the building, structure or the occupants therein, the Fire
Chief, Police Chief or designees shall order the system, unit or device to be repaired and returned
to service, or the building may be vacated until the inoperative system unit or device is repaired
and returned to service. It will be the responsibility of the owner or occupant to make tests, repairs,
alterations or additions providing the appropriate level of system operation.
15.28.060 Exceptions
No portion of this Chapter shall supersede any local, state or federal laws, regulations, or codes
dealing with the life- safety factors.
15.28.070 Unlawful acts designated Violations and penalties
It is unlawful for any person, firm, or corporation to effect, construct, enlarge, alter, repair, improve,
convert, equip, occupy or maintain any building or structure in the Village, or cause the same to be
done, contrary or in violation of any of the provisions of this Chapter. Any person violating the
provisions of this Chapter shall be punished according to the provisions of Chapter 1.08.
15.28.080 Appeal
Any person shall have the right to appeal a decision of the code official to the Village Manager. A
letter for appeal shall be based on a claim that the true intent of this Chapter or the rules legally
adopted thereunder have been incorrectly interpreted, the provisions of this Chapter do not fully
apply, or an equivalent or better method is proposed.

The Village Manager shall affirm, modify, or reverse the decision of the code official.
Section 3. If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any other provision of this ordinance.
Section 4. This Ordinance shall be effective from and after its passage and approval. This
Ordinance may be published in pamphlet form.
