2005-039i � • • ORDINANCE NO. 2005 - 39 GRANTING A VARIANCE FROM SECTIONS 14.40.080 and 14.20.040 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Belmont Village Buffalo Grove, L.L.C., the owner of the property commonly known as 500 McHenry Road, and as hereinafter legally described, has re- quested variations from Section 14.40.080, pertaining to Banners, and Section 14.20.040, pertaining to Embellishments, of the Village's Sign Code for the purpose of installing two (2) advertising banners; one banner to be located on the front of the porte cochere facing McHenry Road, and one banner to be located on the southwest side of the building facing Buffalo Grove Road; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on said request for variations; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the ordinance in question would cause undue and unneces- sary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objective of Title 14 of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: i Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. Variations are hereby granted to Sections 14.40.080 and 14.20.040 of the Village Sign Ordinance to the property legally described as follows: Lot 1 in Belmont Village — Buffalo Grove, being a Subdivision of part of the west half of Section 33, Township 43 North, Range l Least of the Third Principal Meridian, according to the Plat thereof recorded July 11,2001 as Document 4723588, in Lake County, Illinois. for the purpose of installing two (2) advertising banners; one banner to be located on the front of the porte cochere facing McHenry Road, and one banner to be located on the southwest side of the building facing Buffalo Grove Road, which building is located at 500 McHenry Road. Section 3. These variances are subject to the conditions that the petitioner install the subject signs pursuant to the exhibits introduced to the Zoning Board of Appeals during the public hearing thereon and the Findings of Fact rendered thereon and that said advertising banners shall be displayed only for a period not to exceed thirty (30) days from the date of initial installation. Section 4. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified. I further certify that on July 18, 2005 the Corporate Authorities of the Village passed and approved Ordinance No. 2005 -39 entitled: An Ordinance granting a variation of Sign Code, Section 14.40.080, pertaining to banners; and Section 14.40.040, pertaining to embellishments, for Belmont Village provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. 2005 -39, including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing July 19, 2005, and continuing for at least ten days thereafter.
