2004-065ORDINANCE NO. 2004- 65 GRANTING A VARIANCE FROM SECTION 17.20.030 OF THE BUFFALO GROVE ZONING ORDINANCE 515 Buckthorn Terrace WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the Owners, Michael and Deborah Holm of 515 Buckthorn Terrace, Buffalo Grove, Illinois, have requested a variation from Section 17.20.030 of the Buffalo Grove Zoning Ordinance for the purpose of locating a central air conditioner unit in a required front yard; and, WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Zoning Ordinance, the plight of the owner is due to unique circumstances, and the proposed variation will not alter the essential character of the neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Section 17.20.030 of the Village Zoning Ordinance to the real property legally described in Exhibit "A" attached hereto. The specific variation will allow the petitioner to locate an air conditioning unit in the required front yard as depicted in the pictures submitted with the application and marked Exhibit "E ". The existing landscaping must be maintained adjacent to the air conditioning unit. This variation is subject to the Village Engineer's Report dated June 2, 2004. Section 3. This ordinance shall be in effect from and after its passage and approval. This ordinance shall not be codified. The pamphlet form of Ordinance No. 2004 -65, including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing July 12, 2004, and continuing for at least ten days thereafter. .
