6/21/04 • . . 0 ORDINANCE NO. 2004 — 63 AN ORDINANCE APPROVING A PRELIMINARY PLAN IN THE B -2 DISTRICT VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Bank of America 55 Lake Cook Road Proposed bank with drive - through facility WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in EXHIBIT A ( "Property ") attached hereto is zoned in the B -2 Business District; and, WHEREAS, Bank of America, as Lessee of the Property has petitioned to the Village for approval of a Preliminary Plan to construct a bank pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT B Preliminary Plan ( "Site Plan ") dated May 10, 2004 by Gensler EXHIBIT C Preliminary Engineering Plan (Sheet 3 — Grading and Erosion Control, Sheet 4 — Utility Plan, Sheet 5 — Paving Plan) dated as last revised May 10, 2004 by Mackie Consultants, Inc. EXHIBIT F Site Lighting Photometrics (8 %2 x 11 -inch) EXHIBIT G Fence, wall and guardrail detail plan dated May 10, 2004 by Gensler • 2 • EXHIBIT H Building elevations dated March 2, 2004 by Gensler EXHIBIT I Building floor plan dated March 2, 2004 by Gensler WHEREAS, notice of the public hearing concerning the petition for approval of the Preliminary Plan was given, including variations of the Village Zoning Ordinance and Village Development Ordinance, and the public hearing was held by the Buffalo Grove Plan Commission; and, WHEREAS, the Plan Commission determined that the Preliminary Plan is appropriate for the Property, and development of the Property as proposed would be compatible with adjacent properties; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving the Preliminary Plan for construction of a bank with a drive - through facility pursuant to the attached exhibits for the Property legally described in the attached Exhibit A. Section 3. Approval of said Preliminary Plan is subject to the following conditions: A. Variations of Section 16.50.040.C. of the Village Development Ordinance are hereby granted to allow construction of the stormwater storage facility as depicted on Exhibit C hereto. B. A variation of Section 17.36.040.G.2. of the Village Zoning Ordinance is hereby granted to allow fewer than six (6) stacking spaces per customer service are for the bank drive- through facility as depicted on Exhibit B hereto. C. A final landscaping plan shall be submitted to the Village Forester for review and approval prior to any site preparation work or modification to any existing trees or other vegetation on the Property. The site plan, attached hereto as Exhibit B, shall be corrected to accurately delineate the lease line on the Property. E. All applicable fees, bonds and security as required by the Village shall be paid prior to issuance of any permits by the Village. Said fees shall include payment of any outstanding water bills owed to the Village and reimbursement to the Village for the Village Attorney's fees relating to drafting of the four -parry agreement concerning use and development of the Property. G. Approval by the Village of Wheeling of the site plan, engineering plan and related site development plans. H. Approval by the Village of Wheeling of the four -party agreement concerning use and development of the Property. I. Execution of the four -party agreement by each party. J. All signage on the Property is subject to the provisions of the Village of Buffalo Grove Sign Code K. Any changes or amendments to the plans and exhibits approved herein are subject to Village approval, and the Village will determine if additional public hearings are necessary for proposed changes or amendments. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified. SPECIFICATIONS HOUSING The aluminum housing is available in two sizes: Greenbriar Flat Lens Reduced Envelope 1000 Watt lamp and Greenbriar Flat Lens Reduced Envelope 400 Watt lamp. Both housings are the same dimensions square, however, the GFR is deeper. Both are finished to produce a clean, sharp appearance, and designed to ensure weather -tight construction. Top- access covers provide ease of installation and servicing. LENS /GASKET The flat clear tempered glass lens is sealed to the housing with an EPDM gasket, preventing entry of moisture, dust and insects. TOP FASTENERS The four captive stainless steel door fasteners secure the top-access cover to the housing. SOCKETS Porcelain mogul -base sockets. All sockets are pulse- rated.
