2004-0374/7/2004 0 , _ • ORDINANCE NO. 2004 - 3 7 AN ORDINANCE APPROVING A SPECIAL USE IN THE INDUSTRIAL DISTRICT VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Joy of the Game Baseball and Softball Academy 1455 Busch Parkway The Corporate Grove WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in EXHIBIT A ( "Property"} attached hereto is zoned in the Industrial District pursuant to Ordinance 84-40; and, WHEREAS, CGA Investment Trust, L.L.C. is the Owner of the Property; and, WHEREAS, Full Count Enterprises, L.L.C. proposes to lease a space of 12,183 square feet at 1455 Busch Parkway for the purpose of operating a facility for baseball and softball training, and; WHEREAS, said recreational facility requires approval as a special use in the Industrial District; and, WHEREAS, the proposed facility would be developed and operated in accordance with and pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT B Narrative concerning Petition for Concept and preliminary Plan Review dated February 23, 2004 EXHIBIT C Site plan (2 sheets) for 1405 -1495 Busch Parkway, including detail of parking area for Joy of the Game EXHIBIT D Conceptual floor plans dated as received March 5, 2004 WHEREAS, notice of the public hearing concerning the petition for approval of the Special Use was given and the public hearing was held by the Buffalo Grove Plan Commission; and, WHEREAS, the Plan Commission determined that the criteria for a Special Use as set forth in Section 17.28.040 of the Village's Zoning Ordinance have been met and development of the Property as proposed would be compatible with adjacent properties; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terns and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Special Use for operation of a baseball and softball training facility pursuant to EXHIBITS B, C and D for the Property legally described in EXHIBIT A attached hereto. Section 3. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified. Proposed Use The formal name of the proposed facility is "Joy of the Game Baseball and Softball Academy". This facility is a venture between Full Count Enterprises,LLC. and Joy of the Game, Inc., a nationally recognized youth sports program. The principals in Full Count Enterprises, LLC. are David Mandel and Craig Katz. The principal of Joy of the Game, Inc. is Michael Weinstein. The purpose of this venture is to provide high quality training and instruction to baseball and softball players of all ages and skill levels. There will be a variety of programs offered at the facility. These include individual and group instruction in the f nidementaLs of baseball and softball as well as individual and family access to batting cages. The proposed use group designation for this facility is "A -Y" At this time Bu$alo Grove has no other faciity of this type and Full Count Enterprises believe that issuing a permit to operate "Joy of the Game Baseball and Softball Academy" will be a benefit to the village and enhance it's image. Hours of Operation The "Joy of the Game Baseball and Softball Academy" intends to operate seven days per week. The hours of operation on Mondays through Fridays would be from approximately 11:00 am to 9:00 pm. The hours on Saturday would be from approximately 9:00 am to 7:00 pm. The hours on Sunday would be from approximately 11:00 am to 7:00 Pm- Staffing The "Joy of the Game Baseball and Softball Academy" will be staffed by at least two full time employees at all times. There will be times when there are as many seven employees providing instruction to individuals or groups. We do not forsee more than thirteen clients in the facility at any one time. Therefore we do not anticipate having more than twenty people total in the facility at any one time. Parldng Demand and Allocation Based on the maximum number of anticipated instructors and clients at any one time, there will be a need for no more than twenty parking spaces. CGA Investment, LLC., the owner of the property has allocated twenty -four spaces to "Joy of the Game Baseball and Softball Academy ". This allocation exceeds the anticipated usage requirements. Full Count Enterprises, LLC. and "Joy of the Game Basebal and Softball Academy" looks forward to a favorable disposition of their Petition for Concept and Preliminary Plan Review and the issuance of a Special Use Permit.
