2004-019ORDINANCE NO. 2004 - 19 GRANTING A VARIANCE FROM SECTION 17.36.030 OF THE BUFFALO GROVE ZONING ORDINANCE FOR 1540 BUNESCU COURT WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Thomas and Linda Roemer of 1540 Bunescu Court, Buffalo Grove, Illinois, have requested a variation from Section 17.36.030 of the Buffalo Grove Zoning Ordi- nance pertaining to driveways, for the purpose of replacing the existing driveway and adjacent walk that combined exceed the forty percent (40 %) front yard coverage limitation; and, WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Zoning Ordinance, and that (1) the plight of the owners is due to unique circumstances and (2) the proposed variation will not alter the essential character of the neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Section 17.36.030 of the Village Zoning Ordinance to the following legally described real property: 1 Lot 87 in the Crossings Unit Four, being a Subdivision in the South West quarter of the South East quarter of Section 30, Township 43 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded May 25, 1977, as Document 1839079, in Book 60 of Plats, page 25, in Lake County, Illinois. Commonly known as 1540 Bunescu Court. The specific variation will allow replacement of the existing driveway and walk that exceed the forty percent (40 %) front yard coverage limitation. The coverage of the front yard is not to exceed five hundred ten (510) square feet and the driveway is not to exceed an average length of twenty five point five feet (25.5') and a width of eighteen feet (18'). The variation is granted subject to the Village Engineer's Report dated December 2, 2003 and pursuant to plans and specifications submitted to and approved by the Village. Section 3. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified. AYES: 6 - Braiman. The pamphlet form of Ordinance No. 2004 -19 including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing January 6, 2004 and continuing for at least ten days thereafter.
