ORDINANCE NO. 2003 - 71
AN ORDINANCE APPROVING A PRELIMINARY PLAN
IN THE B -1 LIMITED RETAIL BUSINESS DISTRICT
VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, the real property legally described in EXHIBIT A ("Property") attached hereto
is zoned in the B -1 Limited Retail Business District; and,
WHEREAS, Dr. Marvin Heimlich/313 W. Dundee LLC as contract purchaser and
"Developer" of the Property has petitioned to the Village for approval of a Preliminary Plan to
construct a one -story office building with an area of 12,000 square feet pursuant to the following

WHEREAS, notice of the public hearing concerning the petition for approval of the
Preliminary Plan was given and the public hearing was held by the Buffalo Grove Plan Commission;
and,

WHEREAS, the Plan Commission determined that the Preliminary Plan is appropriate for
the Property, and development of the Property as proposed would be compatible with adjacent
properties; and,
WHEREAS, the President and Board of Trustees conducted a public hearing concerning
variation of Section 17.44.020.0.1. and 17.44.020.H.1. of the Village Zoning Ordinance pertaining
to the width of landscaped yards adjoining the east and west lines of the Property; and,
WHEREAS, the President and Board of Trustees after due and careful consideration have
concluded that the development of the Property on the terms and conditions herein set forth would
enable the Village to control development of the area and would serve the best interests of the
Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1. This ordinance is made pursuant to and in accordance with the Village's
Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding
whereas clauses are hereby made a part of this Ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance
approving the Preliminary Plan for construction of the one -story medical office building pursuant
to the attached exhibits for the Property legally described in the attached EXHIBIT A.
Section 3. Approval of said Preliminary Plan is subject to the following conditions:
A. A variation of Section 17.44.020.G.1. of the Village Zoning Ordinance
allowing a landscaped front yard along Golfview Terrace of 10 feet instead
of 13.3 feet, and a variation of Section 17.020.H.1. allowing a landscaped
yard of less than 12 feet for a portion of the east buffer yard as depicted on
EXHIBITS B, C and D are hereby granted.
B. The Developer shall comply with applicable Village regulations, including
submittal of a final plat and execution of a Development Improvement
Agreement pursuant to the Village Development Ordinance.
C. Signs for the Property are subject to the provisions of the Village Sign Code
and Appearance Plan.
D. Exterior lighting shall be designed and maintained to prevent glare or
nuisances for adjacent properties.

E. Landscaping, including new trees, shall be provided in accordance with the
conceptual plantings depicted on EXHIBIT D. A final landscaping plan shall
be submitted to the Village Forester for review and approval prior to any site
preparation work or modification to any existing trees or other vegetation on
the Property.
F. The wood (cedar) board -on -board fence proposed along the south and east
property lines shall be constructed of high- quality materials and shall be
maintained to provide an adequate screen for adjacent properties. Developer
shall plant arborvitae trees as approved by the Village Forester on the outside
(east side) of said fence on the property known as 936 Betty Drive, subject
to approval by the owner of said property.
G. The building elevation as depicted in EXHIBIT F attached hereto shall be
revised to provide windows in the west roof dormers and to add dormers with
vents for HVAC equipment on the east roof elevation.
H. Fire lanes shall be provided as required by the Buffalo Grove Fire Department,
and said fires lanes shall be depicted on the final plat of subdivision or other
document as directed by the Fire Department.
Any changes or amendments to the plans and exhibits approved herein are
subject to Village approval, and the Village will determine if additional
public hearings are necessary for proposed changes or amendments.
Section 4. This Ordinance shall be in full force and effect on and after its passage and
approval. This Ordinance shall not be codified.
