2003-07010/20/2003 • 1 1 0 ORDINANCE NO. 2003 -70 AN ORDINANCE AMENDING ORDINANCE NO. 87-73 CONCERNING THE PLANNED UNIT DEVELOPMENT FOR 650 LAKE COOK ROAD IN THE B -3 DISTRICT BUFFALO GROVE BUSINESS PARK VILLAGE OF BUFFALO GROVE COOK AND LAKE COUNTIES, ILLINIOIS InGear facility 650 Lake Cook Road (formerly Zierk's Home Furnishings store) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, Freedom Two Limited Partnership (hereinafter referred to as "Owner"), is the Owner of the property (hereinafter referred to as the "Property") described in EXHIBIT A attached hereto, which exhibit is made a part hereof, and which real estate is within the corporate limits of the Village; and, WHEREAS, the Property is zoned in the B -3 Planned Business Center District and developed with a commercial building of 28,816 square feet (commonly known as 650 Lake Cook Road) pursuant to Ordinance No. 87 -73; and, WHEREAS, said Ordinance No. 87 -73 stipulates that any use other than the Zierk's Home Furnishings store on the Property requires approval by the Village; and, WHEREAS, the Zierk's use ceased in February 2000 and the Owner of the Property desires to make productive use of the existing building and site improvements; and, • 2 WHEREAS, Owner proposes to lease 25,131 square feet of said building to InGear Inc., including offices and lunchroom (18,760 square feet), a showroom (1,886 square feet), storage area (3,050 square feet) and employee facilities (1,430 square feet), and to use the remaining 3,685 square feet of the building for maintenance and storage, as set forth in attached EXHIBITS B and C hereto; and, WHEREAS, sixty -two (62) off - street parking spaces are provided on the Property, which would accommodate 18,600 square feet of office use based on the Village's zoning standard of one off - street space per 300 square feet of office area; and, WHEREAS, Owner has provided a projection of parking demand (listed on EXHIBIT C) for InGear and the other proposed uses, representing that a total of 46 parking spaces are needed to accommodate all the uses proposed for the Property; and, WHEREAS, the Owner has petitioned to the Village for approval of an amendment to Ordinance No. 87 -73 to allow InGear and the other proposed uses and to allow a zoning variation to permit the existing 62 parking spaces to serve the uses in the building pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT B Floor Plan dated October 16, 2003 EXHIBIT C Table of proposed uses (floor area in square feet) and parking demand (spaces) dated October 16, 2003 WHEREAS, the President and Village Board of Trustees conducted a public hearing concerning the requested variation of the Village's parking standard, and after due and careful consideration have determined that amendment of the Ordinance No. 87 -73, including the variation concerning off - street parking, will allow appropriate use of the Property and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance, and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance amending Ordinance No. 87 -73 to allow use of the Property as represented in EXHIBITS B and C attached hereto, subject to the following conditions: • 3 • A. A variation of Section 17.36.040. of the Village Zoning Ordinance is hereby granted to allow the existing 62 parking spaces to serve the proposed uses on the Property. B. Any change of use on the Property is subject to review and approval by the Corporate Authorities. Section 3. This Ordinance supersedes Section 6. "Special Conditions" of Ordinance No. 87- 73. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
