ORDINANCE NO. 2003 - 21
AN ORDINANCE APPROVING AN AMENDMENT TO A
SPECIAL USE IN THE R -7 DWELLING DISTRICT
VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS
VERNON TOWNSHIP EQUIPMENT FACILITY
West of Community Services Building, 2900 Main Street
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
Illinois Constitution of 1970; and,
WHEREAS, the real property legally described in EXHIBIT A ( "Property ") attached hereto
is zoned in the R -7 Dwelling District with a Special Use for governmental services; and,
. WHEREAS, Vernon Township (Lake County, Illinois) is the Owner of the Property; and,
WHEREAS, the Owner has determined that a facility for, storing and maintaining equipment
used in the provision of recreational and other public services is necessary to in order to maintain
and improve the efficiency of the Township's operations;
WHEREAS, the proposed improvements include a one -story building of 2,300 square feet
with a maximum height of 23 feet, a paved driveway, landscaping, fencing and stormwater
management improvements pursuant to the following exhibits:

WHEREAS, notice of the public hearing concerning the: petition for approval of the
amendment to the Special Use was given and the public hearing was held by the Buffalo Grove Plan
Commission; and,
WHEREAS, the Plan Commission determined that the criteria for a Special Use as set forth
in Section 17.28.040 of the Village's Zoning Ordinance have been met and development of the
Property as proposed would be compatible with adjacent properties; and,

WHEREAS, the President and Board of Trustees after due and careful consideration have
concluded that the development of the Property on the terms and conditions herein set forth would
enable the Village to control development of the area and would serve the best interests of the
Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1. This ordinance is made pursuant to and in accordance with the Village's
Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding
whereas clauses are hereby made a part of this Ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance
approving an amendment to the Special Use and Preliminary Plan for construction of the building
addition, bulk materials storage structure, fence and related site improvements pursuant to EXHIBIT
B for the Property legally described in EXHIBIT A attached hereto.
Section 3. The Special Use is subject to the following conditions:
A. A variation of Section 17.32.030.A. of the Zoning Ordinance is hereby
granted allowing a height of 23 feet instead of 15 feet for the proposed
building as an accessory structure as depicted on EXHIBIT B.
B. The Township shall make modifications to the `fencing on the Property
pursuant to EXHIBIT B, including the removal of barbed wire and the fence
along the south lot line. New fencing (board -on- board) shall be installed
pursuant to EXHIBIT B. All fence modifications shall be in compliance with
the Village's Fence Code and standard permit approval procedures.
C. In the event that fences on the residential properties abutting the south line
of the Property are removed, the Township shall provide screening a
minimum of five feet in height along the south lot line abutting residential
properties.
D. Landscaping shall be provided in accordance with the conceptual plantings
on EXHIBIT B, but a final landscaping plan shall be submitted to the Village
Forester for review and approval prior to any site preparation work or
modification to any existing trees or other vegetation on the Property.
E. Outside storage shall be restricted to the fenced and screened area identified
as "Equipment Storage Area" on EXHIBIT B and pursuant to the provisions
of EXHIBIT C attached hereto. All stored items shall be lower than the top
line of the fencing and screening abutting residential properties. Said storage
shall be maintained in a neat and orderly condition as determined by the
Village, and the Owner shall manage the area to avoid any nuisances or
health hazards.

F. Use of the facility shall be controlled to minimize impacts including, but not
limited to, noise and vehicle exhaust. Activities involving the use of
machinery and repair equipment shall be restricted to the hours between 8:00
AM and 8:00 PM.
G. Equipment and vehicle maintenance activities are restricted to minor repairs
including oil changes and brake repairs. There shall be no major repairs
conducted in the facility. All waste materials including but not limited to oil
and vehicle /equipment parts shall be stored and discarded in compliance with
applicable environmental and safety regulations.
H. Exterior lighting for the building and the immediate surrounding adjacent area
shall be turned off between 10:30 PM and 6:00 AM each day, except for
security lighting approved by the Village. Lighting shall be designed and
maintained to prevent glare or nuisances for adjacent residential properties.
I. Any changes or amendments to the plans approved herein are subject to
Village approval, and the Village will determine if additional public hearings
are necessary for proposed changes or amendments.
Section 4. This Ordinance shall be in full force and effect on and after its passage and
approval. This Ordinance shall not be codified.

that it should be published in pamphlet form.
The pamphlet form of Ordinance No. 2003 -22,
including the Ordinance and a sheet thereof, was '
prepared, and a copy of such Ordinance was posted
in and at the Village Hall, commencing March 18,
2003, and continuing for at least ten days thereafter.
