ORDINANCE NO 2002 — 39
AN ORDINANCE APPROVING A VARIATION OF THE
BUFFALO GROVE DEVELOPMENT ORDINANCE
IN THE INDUSTRIAL DISTRICT
VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS
ABC Plumbing, Inc.

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
Illinois Constitution of 1970; and,
WHEREAS, the real property legally described in EXHIBIT A ( "Property ")
attached hereto is zoned in the Industrial District; and,
WHEREAS, Owner proposes to construct additional parking lot improvements.;
and,
WHEREAS, Owner has petitioned the Village for approval of a variation of the
Village Development Ordinance concerning construction of said building pursuant to the
following exhibits:

Doherty & Associates, dated June 26, 2002
WHEREAS, notice of the public hearing concerning the petition for approval of a
variation of the Development Ordinance was given and the public hearing was held by
the President and Board of Trustees of the Village; and,
WHEREAS, the President and Board of Trustees determined that the conditions
for a variation set forth in Section 16.10.050 of the Development Ordinance have been
met and that development of the Property on the terms and conditions herein set forth
would be compatible with adjacent properties, would enable the Village to control
development of the area and would serve the best interests of the Village.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE
COUNTIES, ILLINOIS:
Section 1: This Ordinance is made pursuant to and in accordance with the
Village's Development Ordinance and the Village's Home Rule powers. The preceding
whereas clauses are hereby made a part of this Ordinance.
Section 2: The Corporate Authorities hereby adopt a proper, valid and binding
ordinance granting a variation of Section 16.50.040.C.3.b.3.) of the Development
Ordinance to allow construction of a vertical wall approximately six and one -half (6 1/2)
feet in height on the west side of the detention basin pursuant to attached EXHIBIT B.
Section 3: This Ordinance shall be in full force and effect on and after its passage
and approval. This Ordinance shall not be codified.

ORDINANCE IN THE INDUSTRIAL DISTRICT

which provided by its terms that it should be
published in pamphlet form.
The pamphlet form of Ordinance No. 2002 -39,
including the Ordinance and a sheet thereof, was
prepared, and a copy of such Ordinance was posted
in and at the Village Hall, commencing on August 5,
2002, and continuing for at least ten days thereafter.
Copies of such Ordinance were also available for
public inspection upon request in the Office of
Village Clerk.
