AN ORDINANCE APPROVING A VARIATION OF THE
BUFFALO GROVE DEVELOPMENT ORDINANCE
VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, the real property legally described in EXHIBIT A ( "Property ") attached hereto
is contiguous to the Village of Buffalo Grove and is zoned R -3 Residential by Lake County; and,
WHEREAS, Howard and Susan Derdiger are the Owners of the Property; and,
WHEREAS, Owners propose to construct a driveway apron on the Village -owned parkway
of Horatio Boulevard adjoining the Property, and said apron will exceed the 18 -foot width standard
of the Village Development Ordinance for an apron serving a two -car driveway; and,
WHEREAS, Owners have petitioned the Village for a variation of the Development
Ordinance to allow construction of said driveway apron in the parkway pursuant to the following
exhibits:

WHEREAS, notice of the public hearing concerning the petition for approval of a variation
of the Development Ordinance was given and the public hearing was held by the President and
Board of Trustees of the Village; and,

WHEREAS, the President and Board of Trustees determined that the conditions for a
variation as set forth in Section 16.10.050 of the Development Ordinance have been met and that
development of the Property on the terms and conditions herein set forth would be compatible with
adjacent properties, would enable the Village to control development of the area and would serve
the best interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1. This ordinance is made pursuant to and in accordance with the Village's
Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are
hereby made a part of this Ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance
granting a variation of Section 16.50.080.A.2.b. of the Development Ordinance pursuant to
EXHIBIT B to allow the construction of a residential driveway apron for a two -car driveway 22 feet
wide at the property line adjoining the parkway of Horatio Boulevard and 24 feet wide at the east
pavement edge of Horatio Boulevard.
Section 3. This Ordinance shall be in effect from and after its passage and approval. This
Ordinance shall not be codified.
