2000-0480 0 ORDINANCE 2000- 48 GRANTING A VARIANCE FROM SECTIONS 15.20.050 OF THE BUFFALO GROVE FENCE ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Michael and Dana Pinsel, 2901 Acacia Terrace, Buffalo Grove, Illinois, are requesting a variation from Section 15.20.050 of the Buffalo Grove Fence Code, for the hereinafter legally described real property located at 2901 Acacia Terrace, Buffalo Grove, Illinois, for the purpose of installing a five (5) foot fence at the rear of their yard abutting the Arboretum Golf Course; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variation; and WHEREAS, it is the intention of the Corporate Authorities that the variance granted herein not continue in force after the current owners are no longer in residence unless an in- ground pool is constructed on the property; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Fence Ordinance, and that the fence would not be detrimental to the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Sections 15.20.050 of the Village Fence Code Ordinance to the following legally described real property: See Exhibit "A" attached hereto. H LE The specific variation is to allow the petitioners to install a five (5) foot fence surrounding their rear yard that would abut the Arboretum Golf Course. This variation is subject to the condition that the fence be constructed with materials approved by the Village and pursuant to the plat of survey submitted with the petition. Section 3. This variance shall be deemed terminated, without further action of the Corporate Authorities, and the fence removed upon any sale, conveyance or transfer of title or beneficial interest in or to the property if, at the time of such sale, conveyance or transfer, an in- ground pool is not installed on the property. Section 4. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified.
