2000-0370 ORDINANCE 2000- 37 GRANTING A VARIANCE FROM SECTIONS 14.20.050 and 14.20.070 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Rogers Center For Commerce, Owner of the hereinafter legally described real property located at 1622 Barclay Boulevard, Buffalo Grove, Illinois, on behalf of the Trane Company, has requested a variation from Sections 14.20.050 and 14.20.070 of the Buffalo Grove Sign Code for the purpose of installing a ground sign, and, WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the ordinance in question would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objective of this title of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: 0 0 Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. Variations are hereby granted to Sections 14.20.050 and 14.20.070 of the Village Sign Code Ordinance to the following legally described real property: See Exhibit "A" attached hereto. The specific variations permit the installation of a ground sign per the drawing and plat of survey attached to the petition. The variations are conditioned upon the sign being constructed in compliance with the plans and exhibits submitted to and approved by the Village. Section 3. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified. PUBLIC HEARINGS: After due notice as required by law, a copy of said publication notice being attached hereto as Exhibit "C" the Zoning Board of Appeals held a Public Hearing regarding the proposed variance on Tuesday, June 20, 2000 at the Village Hall, 50 Raupp Blvd. The applicant's representative, Joe Dudzinski, Branch Manager, Trane Company, 1622 Barclay Boulevard, testified at the hearing and presented documentary evidence. No objectors appeared at the hearing. No written objections were received. Attached hereto and made a part hereof as Exhibit "J" are the minutes of the Zoning Board of Appeals Meeting held on Tuesday, June 20, 2000 IX. FINDINGS: The Zoning Board of Appeals finds that the criteria as set forth in Section 14.44.010, Subsection A of the Sign Code have been met in that the Petitioner has shown: A.1. That not allowing the variance will cause undue and unnecessary hardship due to the following unique conditions: a. Building is not visible from Barclay Boulevard because of existing land- scaping and Pace Bus Stop. 2. That granting the requested variance would not be detrimental to the property owners in the vicinity. 3. That the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and 4. That granting of the variance will not be contrary to the general objective of this Title of moderating the size, number and obtrusive placement of signs and the reduction of clutter. X. CONDITIONS: The variance shall be subject to the following conditions: 1. Signs are to be as presented per the exhibits submitted with the application. XI. CONCLUSION: The Zoning Board of Appeals, by a vote of 6 to 0, recommends to the Village Board, that the request of Rogers Center for Commerce on behalf of The Trane Company, 1622 Barclay Boulevard, for variance of Sign Code, Section 14.20.050,pertaining to Industrial Districts; and Sign Code, Section 14.20.070, pertaining to Ground Signs, be granted. Horwitz observed that the neighbor's fence is also located outside of the utility easement. He asked who would maintain the area in between? He would prefer to have the fence setback farther than 10 feet. Mr. Richards said the Village mows most of the space. He has been mowing the rest and will continue to do so. Ch. Entman referred to Mr. Schar's memo that states "the rear of this property abuts an area that provides access to Outlot"B ", which is owned and maintained by the Village of Buffalo Grove. He would also like to have the fence set back farther the Village Engineer's recommendation. Com Krakauer saw the neighbor's landscaping at 425 Mayfair Lane and said the fence would look better if it is setback seventeen to twenty feet from the sidewalk. Mr. Richards responded that he understands he could put up a three (3) foot fence out to the sidewalk if it is broken. He is only requesting a four (4) foot fence and he does not want to go all the way to the sidewalk. After disucssion, the Commissioners and Mr.Richards agreed on a location fifteen (15) feet from the sidewalk. Com. Windecker made the following motion: I move we grant the request of Kevin and Dawn Richards, 541 Mulberry Court, for variance of Municipal Code, Section 15.20.040, pertaining to Residential Districts, for the purpose of installing a four (4) foot wood picket fence that would be located a distance of fifteen (15) feet from the sidewalk along Mayfair Lane, per an amended petition to be submitted with an application to the Building Department. Unique circumstances having been demonstrated, the proposed fence will not be detrimental to the public health, safety and welfare and will not alter the essential character of the neighborhood. Com. Notice of the public hearing was published in the Daily Herald on May 31,12000. Mr: Dudzinski was authorized by Ms. Kathi Rogers to make the presentation. Mr. Dudzinski said Trane is a commercial heating and air - conditioning company. The building is located at the southwest comer of the first lot in the Rogers Center for Commerce. The existing landscaping and the Pace bus stop hides the building. The 3'6" x 3' single -faced non - illuminated sign will permit contractors to find the building. If the sign is placed in front of the building, it will not be seen, so with the landlord's approval, it will be located between parking lot and the pond. It will be seen after turning into the parking lot from Aptakisic Road They work through commercial contractors and have no walk -in business. The main purpose of the sign is to identify the product "TRANE" and they have a five (5) year lease. ZONING BOARD OF APPEALS JUNE 20, 2000 — PAGE THREE Com. Lesser asked if there were any other signs on Barclay Boulevard. He would not want to see a lot of different signs. Would this sign set a precedence. Mr. Schar recalled that a Havitol sign at the south end of the Rogers Center that was approved several years ago but he did not know if it is still there. Mr. Dudzinski said there are many other signs down Barclay. W.W. Granger and Gustave Larsons. are competitors and both of these companies have large signs. Com. Teplinsky had no objection to this sign and said the Zoning Board has the ability to police any activity on Barclay Boulevard in the future. Ch. Entman affumed that the policy has been to review each petition on its face and act accordingly. Com. Horwitz said he has observed many other facilities had illuminated window signs. Would Trane consider a window sign? Mr. Dudzinski said they typically have a logo decal on the window and doors, with ground signs. Com. Krakauer knows the Larsons sign is quite large and Trane needs some identification. Christine Devitt, 1253 Selwyn Lane, said she likes signs because they indicate a healthy economy. Com. Windecker made the following motion: I move we recommend to the Village Board of Trustees that the request made by Rogers Center of Commerce on behalf of The Trane Company, 1622 Barclay Boulevard, be granted. that would permit variance of Sign Code Section 14.20.050, pertaining to Industrial Districts and Section 14.20.070 pertaining to Ground Signs for the purpose of installing a ground sign.per the drawing and plat of survey attached to the petition.
