2014-12-01 - Ordinance 2014-079 - APPROVING AN AMENDMENT TO ORD 2013-24 FOR SPECIAL USE AT 355 HASTINGS DRORDINANCE NO. 2013-24 A SPECIAL USE IN THE INDUSTRIAL DISTRICT VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Max Training Center, LLC: 355 Hastings Drive Chevy Chase Business Park West (Miasmer Hastings Subdivision) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in EXHIBIT A ("Property") attached hereto is zoned in the Industrial District pursuant to Ordinance No. 97-83; and, WHEREAS, Hastings Building LLC is the owner of the Property; and, WHEREAS, the Village approved Ordinance No. 2010-8 granting a special use for Multisport Athletics, LLC to operate a recreation facility for sports training at the Property; and, WHEREAS, the Village approved Ordinance No. 2018-24 amending the special use to name Max Training Center, LL[as the operator of the facility approved by Ordinance No. 2OlO- WHEREAS, Max Training Center, LL[ (hereinafter referred to as the "Petitioner") has requested amendment of the special use to allow volleyball tournaments and leagues at the facility; and, WHEREAS, the Village Planning & Zoning Commission conducted a public hearing on November 5, 2014 concerning amendment of the special use to allow volleyball tournaments and leagues; and, 2 WHEREAS, the Planning & Zoning Commission determined that amendment of the special use as presented in testimony at the public hearing meets the criteria for a special use as set forth in Section 17.28.040 of the Village's Zoning Ordinance and use of the Property as pnmposa d would b e compatible with adjacent properties, an d the Commission voted 7 to 0t to recommend approval of the amendment of the special use; and, WHEREAS, the facility would be operated in accordance with and pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT Petitioner's Acceptance and Agreement concerning special use EXHIBIT C Max Training Center Overview EXHIBIT Letter dated October 23, 2014 from Mike Powers, Mmho Properties EXHIBIT E Floor plan of facility WHEREAS, the Village President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. yJO\A/THEREFCJRE@E[TC}0DA|NEDBYTHEPRES|DE0TAND BOARD OF TRUSTEES (]FTHE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding Whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hens6u adopt a proper, valid and binding ordinance approving an amendment of the special use allowing volleyball tournaments and leagues at the Max Training facility pursuant to the exhibits hereto for the Property legally described in Exhibit A attached hereto, subject to the following conditions: A. The special use, as amended, granted to Max Training Center, LLC is assignable to subsequent petitioners seeking assignment of this special use as follows: I. Upon application mfa petitioner seeking assignment mfthisspeda| use, the Corporate Authorities, in their sole discretion, may refer said application of assignment tmthe appropriate commission(s) for a public hearing wrmay hold a public hearing at the Village Board. 2. Such assignment shall be valid only upon the adoption of a proper, valid and binding ordinance by the Corporate Authorities granting said assignment, which may begranted or denied for any B. The facility shall be used for individual and team training and volleyball tournaments and leagues as represented in the exhibits hereto. Any other activities in the facility are subject to review and approval by the Section 3. This Ordinance shall bein full force and effect upon the submittal ofthe executed Petitioner's Acceptance and Agreement attached hereto as Exhibit G. This Ordinance shall not becodified.
