2014-11-03 - Ordinance 2014-075 - APPROVING AN AMENDMENT TO SPECIAL USE FOR EMMERICH EAST PARK PUBLIC ADDRESS SYSTEM AT 151 RAUPP BLVD10/28/2014 l •c• •• • DISTRICT SPECIAL USE IN THE R-3 DWELLING VILLAGE OF • GROVE, COOK AND LAKE COUNTIES, ILLINOIS EMMERICH EAST PARK Public Address System 151 Raupp Boulevard WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in EXHIBIT A ( "Property ") attached hereto is zoned in the R -3 Dwelling District with a Special Use for a public address system; and, WHEREAS, the Buffalo Grove Park District is the Owner of the Property (Emmerich East Park); and, WHEREAS, the Owner allows the Bills Youth Football Association to use Emmerich East Park for youth football games; and, WHEREAS, the Village approved Ordinance No. 92 -81 allowing the use of a public address system for a specified number of games, days and times on the Property; and, WHEREAS, the Village approved Ordinance No. 2003 -53 approving amendments concerning the schedule for use of the public address system by the Bills Youth Football Association; and, WHEREAS, the Owner and the Bills have requested an amendment of Ordinance No. 2003 -53 to allow additional modifications to the schedule for use of the public address system by the Bills Youth Football Association; and, 2 VVHEREAS, notice of the public hearing concerning the petition for amendment to the Special Use was given and the public hearing was held by the Buffalo Grove Planning and Zoning Commission on October 15, 2014; and, WHEREAS, the Planning and Zoning Commission determined, pursuant 1ofindings based mn the testimony presented at the public hearing, that the criteria for a Special Use as set forth in Section 17.28.040 of the Village's Zoning Ordinance have been met, and expanded use of the public address system would be compatible with adjacent properties; and, WHEREAS, the President and Board of Trustees do hereby find that the criteria for a Special Use set forth in Section 17.28.040 of the Village's Zoning Ordinance have been met regarding the use of the public address system for a total of ten weekend days over a period of not more than five weekends per football season, and that the use of the Property on the terms and conditions herein set forth would serve the best interests of the Village. 1101T', THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, Section 1. This ordinance is made pursuant hm and in accordance with the Village's Zoning Ordinance and the Village's Horne Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby approve an amendment to the Special Use for the Property legally described in EXHIBIT A attached hereto. Section 3. The Special Use bsubject to the following conditions: A. The use of the public address system shall belimited tma total mf ten weekend days (5 Saturdays and 5 Sundays) over not more than five weekends per football season. The Bills Youth Football Association shall give at least 72 hours notice to the Buffalo Grove Park District, the Village of Buffalo Grove Police Department, the Village Building Commissioner and a designated neighborhood leader prior to dates of planned usage. B. The public address system shall be used only between 9:00A.M. and 5:30 P.M. on Saturdays, and between 9:00 A.M. and 4:30 P.M. on Sundays. C. The use of the public address system shall be limited to the following: 1. To announce the names ofplayers and other persons involved in each game with music in the background; 3 2. To play music for the performances of the cheerleaders 3. To make emergency notifications D. The public address system shall be located and maintained to direct sound away from adjacent residential areas. The system shall not produce sound exceeding a level of seventy (70 dB) decibels (slow meter response) at the property lines of Emmerich East Park. E. The Park District shall inform the Bills Youth Football Association concerning the terms and conditions of this Ordinance. The Park District shall provide notification concerning this Ordinance on an annual basis to the Bills organization. F. In the event that complaints are filed with the Village concerning the use of the public address system, the Bills Youth Football Association shall take immediate action to mitigate the causes of said complaints. If any terms or conditions of this Ordinance are violated, the Special Use authorization is subject to immediate revocation by the Village. Section 4. This Ordinance supersedes Ordinance No. 2003 -53. Section 5. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
