WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and

A. A "driveway apron" as set forth in this Chapter, is that portion of any driveway providinV
ingress and egress to private property from the sidewalk, if any, to the street. If there is no
sidewalk, the ingress and egress will be from any lot or property line to the street.
B. A "service walk" is that part of any sidewalk providing access to private property from the
sidewalk, if any, to the street.

12. .030 Construction work—Permit fee.
Before any driveway apron, service walk, carriage walk or other appurtenance permit is issued,
there shall be paid to the Village Clerk a permit fee of twenty-five dollars. No permit fee shall be
charged where applicant has obtained a building permit for new construction.
12.08.040 Maintenance.
A. Every person maintaining any driveway apron, service walk, or carriage walk in the
Village shall keep the same in good condition and repair.
12.0 .05 – Penalty.
Any person violating the provisions of this Chapter shall be punished according to the
provisions of Chapter 1.08.
Section 3 Chapter 12.09, Parkway Maintenance Responsibilities of Abutting Property
Owners is hereby added to the Buffalo Grove Municipal Code, with additions in underline text,
so that Chapter 12.09 shall hereafter provide as follows:

PROPERTY OWNERS.
H. This section is enacted solelv for the purpose of promoting the preservation of proper
drains re over and the attractive apUarance of public rights of way in the Village, including
t)arkways and public sidewalks. This section creates no dutv on the Dart of anv property owner
in the Village running to anv party other than the Village, and this section does not create any
ri6t of action for the benefit of any private party against anV property owner in the Village or
a gainst the Village based on the failure of a property owiier in the Villa!" to fulfill aiiy
obligation to the Village imposed by this section.
1. In the event that Villa&ce utility or street operations cause damage to a public right of way. the
Villa e shal I repair the right of way accordi ng to Villa re stand ards. Unless speci fi c 12cn-nitting
has been issued, the Village reserves the right to remove sprinkler systems and other obstructions
from the right of way if deemed an obstruction by the Village. In the event that damage is
caused by Village utility or street operations to any unusual drivewav materials. such as stamped
or colored concrete or as or specialty material avers located within the public right of way.

understanding that the Villa may reimburse the owner for the normal cost of concrete as
determined by the Village. In the event that damage is caused by Village utility or street

Section 5. This ordinance shall be in full force and effect from and after its passage,
approval and publication.
