2014-07-07 - Ordinance 2014-048 - APPROVING AN AMENDMENT TO THE SPECIAL USE - BUSCH GROVE COMMUNITY PARK - 801 MCHENRY RD7/1/2014 Aft ORDINANCE APPROVING AN AMENDMENT TO THE SPECIAL USE IN THE RESIDENTIAL ESTATE DISTRICT, VILLAGE OF BUFFALO GROVE. CO Golf and Sports Center Dome, 801 McHenry Road Mike Rylko Community Park WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in Exhibit A ("Property") attached hereto is zoned in the Residential Estate District with a Special Use for public park facilities pursuant to an Annexation Agreement dated March 20\ 2995 approved by Village Ordinance Ng. 95-26, with specific plans for development and operation of the Learning Center being approved by Village Ordinance No. 98-I4;and, WHEREAS, the Special Use on the Property was amended by Village Ordinance 0m. 2002-35 which allowed the dome to remain in place year-round, extended the use of the facility pursuant to the Exhibits attached tosaid Ordinance, and further allowed the dome structure to remain in place until May 31, 2006; and, WHEREAS, the Buffalo Grove Park District requested that the Village amend Ordinance No. 2002-35 concerning removal of the dome by the May 31, 2006 to allow the dome to remain in place in order to continue golf activities and other recreational uses permitted by said Ordinance, approval of which was granted by adoption of Ordinance No. 2007-14, including the stipulation that the dome would be removed by June 1,30l5;and, WHEREAS, the Buffalo Grove Park District requested that the Village amend Ordinance No. 2007-14 to a||ovv additional activities and recreational uses, approval of which was granted by adoption of Ordinance No. 20O9-4. inc|uding the stipulation that the dome would be removed by June l,2O15;and, WHEREAS, the Buffalo Grove Park District plans to upgrade the Golf and Sports Center facility, including new heating and air-conditioning system and replacement ofthe exterior dome material; and, 2 WHEREAS, the Buffalo Grove Park District has requested amendment of Ordinance No. 2OO9-4to allow the dome to remain in place beyond the date of June 2-2DI5 stipulated insaid Ordinance due to the scope and cost of the planned improvements to the facility; and, WHEREAS, the President and Board mf Trustees after due and careful consideration have concluded that the development mf the Property mn the terms and conditions herein set forth would enable the Village to control development mfthe area and would serve the best interests mf the Village. ENNIS ff. M-IO Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby amends Village Ordinance No. 2009-4 by amending Section 3.A. and Section 3.B. thereof to read as follows: S�i The air-inflated dome structure k3oU[ and Sports Center 0mnne\ may remain inflated year-round but shall be removed on or before June 1, 2030. Appropriate repairs and maintenance shall be performed as necessary, including maintenance of the appearance of the structure. I8. The fad|hx may be used for golf practice and training, sports practice and training and other activities such as fitness walking, calisthenics, running and jumping, as appropriate for the facility, a rnaninmurn of 256 days per year with daily operating hours ofG:00a.nn. to midnight during the operational season, in conformance with the "Golf Center Occupancy Summary" attached hereto as Exhibit B. The maximum facility occupancy is limited to 300 persons with the maximum occupancy of the Turf Area limited to no more than 90 persons. All activities shall be supervised and managed by employees of the Park District. Section 3. The Buffalo Grove Park District shall present the proposed replacement dome material to the Village for review and approval. Section 4. Village Ordinance No. 2009-4 remains in full force and effect except as amended herein. Section 5. This Ordinance shall be in full force and effect on and after its passage and approval.
