WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, BG Carwash Management LLC is the owner ( "Owner ") of the property legally described in Exhibit A hereto (the "Property "), and, WHEREAS, the Property is approved as a planned unit development (PUD) zoned in the B -1 Limited Retail Business Center District approved by Village Ordinance No. 96 -9; and, WHEREAS, Village Ordinance No. 96 -9 limits the allowed uses on the Property as set forth in Section 20.D. of said Ordinance; and, WHEREAS, HMB Group, Inc. d /b /a Mugs Pizza and Ribs of Buffalo Grove ( "Petitioner ") has petitioned the Village to amend Ordinance No. 96 -9 to add "take out & delivery food use" to the list of allowed uses on the Property as set forth in said Ordinance; and, WHEREAS, the Village Plan Commission conducted a public hearing on June 18, 2014 concerning the petition for amendment of the Planned Unit Development; and, WHEREAS, the Plan Commission determined that the testimony and exhibits presented 1� by HMB Group, Inc. at the public hearing demonstrated that the requested amendment of r' 2 Ordinance No. 96'9 to allow a take out & delivery food use would be consistent with the allowed uses onthe Property and vvmu|d not have detrimental impacts on adjacent properties; and, WHEREAS, the Plan Commission voted 5 to l to recommend approval of the amendment of the Planned Unit Development to allow a take out & delivery food use pursuant to the following exhibits: EXHIBITA Legal Description of Property EXH I BIT B Acceptance and Agreement concerning PUD amendment E*H| BIT C Operational information and business description (Mugs Pizza and EXHIBIT D Proposed floor plan of lease space EXHIBIT E List of allowed uses on the Property (amendment ofSection 20.D. of Village Ordinance No. 96-9) WHEREAS, the President and Board mf Trustees mf the Village of Buffalo Grove have determined that the amendment of the Planned Unit Development as set forth in the exhibits hereto will a||oxv appropriate use of the Property and will be compatible with adjacent properties. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance (the "Ordinance") is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Horne Rule powers. The preceding whereas clauses are hereby incorporated herein. Section 2. The Corporate Authorities hane6» adopt a proper, valid and binding ordinance approving an amendment of the planned unit development (PUD) for the Property to add a take out & delivery food use to the list of allowed uses on the Property pursuant to the exhibits hereto. Section 20.D.mf Village Ordinance No. 96-9is hereby amended and superseded bV Exhibit E hereto listing the allowed uses on the Property. Section 3. The amendment of the planned unit development is subject to: A. Issuance of applicable Village permits for the take out &delivery food use. W B. Provision of adequate waste disposal, as determined bvthe Village, for the uses on the Property. Section 4. Village Ordinance 0o. 96-9 remains in full force and effect except as modified herein. Section 5. This Ordinance shall be in full force and effect upon the submittal of the executed Acceptance and Agreement, Exhibit Bofthis Ordinance. This Ordinance shall not be codified.
